A DRUNK man who had been out celebrating his new Sellafield job became ‘aggressive’ in a Chinese takeaway and threw punches at a man outside.
Luke Delahaye, 21, was in the Golden Lion takeaway in Whitehaven on September 15 when he became involved in a disagreement. He was seen on CCTV ‘pointing’ and ‘being aggressive’.
Outlining the case at Workington Magistrates’ Court, prosecutor Pamela Fee said police had been parked on Duke Street and came across an incident outside the takeaway. An officer said she saw a group of males fighting outside.
Delahaye was seen throwing several punches at a male and was handcuffed by police. He was then arrested for affray.
During police interview, the defendant said he had been in Shakers and Joe Bananas and was drunk when he went to the takeaway.
He said he could remember a man ‘being a bit rude’ to a member of staff. The defendant said the man was being racist and he had taken it upon himself to ‘do something about it’.
John Cooper, defending, said: “On that night, he had just got a job working at Sellafield. He had gone out to celebrate with his mates. He met his partner and they had gone to get some food.
“The gentleman was being abusive to members of staff. There is a conversation between the two of them.
“Police see the tail end of this after this gentleman has thrown two or three punches. I don’t think anyone really know who threw the first punch.
“He has never been before the court. He’s telling me there was significant provocation.
“He did cooperate with the police at interview and said it was his fault for arguing in the takeaway in the first place.”
Delahaye, of Bridge End, Egremont, pleaded guilty to using threatening, abusive, insulting words or behaviour with intent to cause fear of or provoke unlawful violence.
The defendant was fined £640 and must pay £85 costs and a £256 victim surcharge.
