A MAN was arrested just after bumping into his defence solicitor who had told him, ‘I hope you’re keeping out of trouble’.

David Macauley, 40, began shouting and swearing at police after being arrested in a supermarket car park following a train journey home, Workington Magistrates’ Court heard.

Outlining the case, prosecutor Pamela Fee Police were called at 4pm on October 23 to a report of a male who was drunk in the car park of Whitehaven Tesco.

Officers attended and arrested him for an unrelated offence. He started shouting and swearing, calling one of the officers a ‘lying b******’ and a ‘f****** little clip’.

Ms Fee said the car park was busy and there were members of the public including young children present.

John Cooper, defending, said: “It’s a running joke, if I say they [defendants] are doing well, they end up getting arrested.

“I saw him that day, spoke to him and said I hope you are keeping yourself out of trouble.”

Mr Cooper said Macauley had been arrested after getting the train home from Maryport.

He told the court that British Transport Police had since checked CCTV footage from the train journey and saw Macauley had ‘done nothing wrong’.

Mr Cooper said: “I’ve dealt with him for years. He’s got significant mental heath issues.

“He would like to pass on his apologies. If he had gone quietly with police, they would have investigated and let him go.

Macauley, of Peter Street, Whitehaven, pleaded guilty to using threatening, abusive words or behaviour likely to cause harassment, alarm or distress.

He was fined £80 and ordered to pay £85 costs and a £32 victim surcharge.
